Free Market Foundation to challenge Labour Relations Act in court

On Tuesday, the Free Market Foundation filed a constitutional challenge to South Africa’s labour relations Act 1 in the Gauteng North High court.

Chairman of the FRF Herman Mashaba says the basis of the challenge is the constitutionality, negative effect and unintended consequences of the legislation which permits the extension of bargaining council agreements to different parties.

Herman Mashaba said that there are many bargaining councils within the country, they are working with trade unions to decide on conditions of employment within a particular sector.

“Once they agree on conditions the agreements are given to the Minister of Labour who then forwards to let it be the law for that sector” Mashaba added.
