The Department of Correctional Services will challenge the release of two of the Waterkloof four from prison.
Gert van Schalkwyk and Reinach Tiedt went to prison for killing a homeless man in 2001.
Prison authorities ignored the court order to release the two under house arrest.
Correctional Services was instructed to appear in court in January for not releasing the two.
All the Waterkloof four were sentenced in 2008 to 12 years in jail.
Gert and Reniach only served three.
