Solidarity-Malema can be prosecuted

Solidarity says the former ANC Youth League leader, Julius Malema, can be prosecuted on charges of incitement to violence given that the definition of this crime does not distinguish between successful and unsuccessful incitement.

Solidary`s Johan Kruger said it is thus immaterial whether the continuing violence in the mining industry was indeed influenced or caused by Malema’s statements.

Kruger said for these crimes he can be charged and if found guilty, then a sentence can be given.

He added that there could also be charges of intimidation.
