The South African Domestic Allied
Workers Union which governs and protects domestic workers has filled an open
application that is for the Constitutional Court claiming the exclusion of
domestic workers from the Compensation for Occupational
Injuries and Diseases Act is unconstitutional.
SADSAWU filled the application because the daughter
of a deceased domestic who, died while at work wants to contest the ruling at
the North Gauteng High Court. The daughter who is known as Sylvia Mahlangu is
represented by the Socio Economic Rights Institution of South Africa. Mahlangu
said the family her mother used to work for paid her mother R2 500 a month and
the family she worked for allegedly paid the Mahlangu family less than R5 000
for the funeral. Mahlangu said she was excluded from claiming from the
Compensation for Occupational Injuries and Diseases Act. Mahlangu doesn’t understand
why she was not allowed to claim funds from the organisation as the
organisation compensates employees for work related injuries.
The Socio Economic Rights Institution has
approached the Constitutional courts on Wednesday with their statement made by
Sylvia. A court date hearing has not been confirmed yet.
