The South African Human Rights Commission said it is deeply concerned at the withdrawal of five parties to the Marikana Commission of Inquiry.

Last week, the North Gauteng High Court in Pretoria dismissed Advocate Dali Mpofu's application for the state to pay the legal costs of his clients.

The SAHRC has called upon government to make funds available to the injured and arrested parties to enable the continued participation in the commission process.

SAHRC Spokesperson Isaac Mangena said that as a commission they believe it remains the state and legal aid board have the discretion to actually fund the processes.

“As the situation now stands you have the police on the one hand that are also responsible for the case has representation and funding from government, yet there are those who are complaining, those who were killed during the Marikana massacre their families don’t have access to those services,” added Mangena.

He also added that as the SAHRC they are calling on government to make funds available to the injured and the arrested parties and in the meantime thy will remain a participant in the commission.
