The Police Ministry says it cannot simply arrest children who are found standing around during normal school hours.
Three students were photographed drinking alcohol in school uniform and it created a public outcry.
Minister Nathi Mthethwa said the police ministry will strengthen its relationship with school-governing bodies and communities to address the issue of children found loitering during school hours.
The minister added that children who were arrested could only be held for shorter periods and then released.
Spokesperson Zweli Mnisi says police must act in accordance with the Child Justice Act.
