According to the DA, evidence has emerged that shows that the National Prosecuting Authority (NPA) has been aware that the legislation regarding sexual offences had flaws since 2010.
The DA’s shadow minister of Justice and Constitutional Development Debbie Schafer said that the flaws were highlighted in a recent ruling in the Western Cape High Court.
She added that 29 sexual offences provided for in the Sexual Offences Act may not constitute offences because of a lack of specific penalty guidelines.
Schafer added that the issue was raised by Advocate Pieter Botha to the NPA on two occasions
