Cosatu applauds progressive judgement on garnishee orders against workers

The Congress of the South African Trade Unions applauded the progressive judgement issued by Judge Seraj Desai on July 9th, declaring the current administration of garnishee orders unconstitutional.

Cosatu’s Parliamentary Officer Matthew Parks said, the union is committed in working with the Department of Justice and Parliament to see this happen as a matter of the outmost urgency.

Parks said we view this as a huge victory for workers because the longer can loan sharks simply go to a court and have garnishing orders issued against poor workers without them being aware of it, without engaging them, without the Judges making sure that the worker can afford it and consent to it.

“Currently what happened with this case is that, loan sharks would go to magistrate courts, far where the worker is living to get garnish orders”.


We welcome that government didn't oppose this case and the fact that government supports this case and as committed as self-commending the law to make sure the workers’ rights are protected, Parks added.
