Driver whose taxi overturned whilst transporting school kids, killing one, gets bail

A 25-year-old minibus taxi driver who was charged with causing an accident in Mitchell’s Plain on Friday, in which a 16-year-old learner died and another 28 were injured, has been released on bail of R1 500.

Pule Mbagani appeared in the Mitchells Plain Magistrate's Court on Monday on charges of culpable homicide. He was transporting school children to different schools in Wynberg and Mitchells Plain areas, when the minibus taxi lost control and overturned between Tafelberg Road and Spine Road on Swartklip Road.

Police initially arrested Mbagani for culpable homicide, driving without a valid driving license, un-roadworthy vehicle and overloading.

The National Prosecuting Authority (NPA) spokesperson in the Western Cape, Eric Ntabazalila, says more charges may be added as the investigation continues.

Mbagani's bail condition states that he may not contact any of the witnesses or their parents; he is also not allowed to drive any vehicle; and he should reside at another address and should not enter Khayelitsha as this is where most of the learners reside

The case was postponed to 10 December for further investigation.
