PRASA was ordered by the Western Cape High Court to return personal belongings of land occupiers

Passenger Rail Agency of South Africa attempted to evict land occupies without a court order who had been living in informal structures and tents on Transnet-owned land along marine drive.

During the eviction attempts, PRASA took building materials and personal belongings of occupiers.

Last week Housing group Ndifuna Ukwazi requested an urgent interdict to prohibit PRASA from evicting occupiers unlawfully.

The Western Cape High on Friday ordered PRASA to handover building materials and personal belongings in 24 hours and if they fail to do so, PRASA must replace and construct new temporary dwellings for the occupiers.

Ndifuna Ukwazi welcomed the ruling.

“This is an absolute vindication of the constitutional right not to be evicted without a court order and a celebration of why we have a Constitution that prevents this type of criminal behaviour by State entities. This is a celebration of our human rights and our Constitution,” said Attorney at Ndifuna Ukwazi Law Centre, Dr. Jonty Cogger.
