The Defence Department’s decision to fire soldiers, who were part of the violent protest at the Union Buildings last year, was found unlawful and unconstitutional by the North Gauteng High Court today.
Not only that, but the court has also stopped the department from firing the soldiers until the matter has been heard by the Military Bargaining Council.
The Defence Department said it was studying the judgment and will decide today whether to appeal.
The South African National Defence Union spokesperson Mosima Mosima said the court’s decision has justified the union.
