The National Debt Mediation Association said it is concerned that consumers are being bullied or misled by credit provider collections agents who deliver section 129 notices or letters of demand.

CEO of NDMA Magauta Mphahlele said some agents do not explain the consumer’s rights and obligations.

Mphahlele said they are seeing a trend where instead of mailing section 129 notices or letters of demand. Credit providers are using collection agent.

A lot of these collection agents would approach a consumer either at home or at work. But what we are seeing consumers do not know their rights and these rights are not explained to them properly.

They agree to arrangements that are not affordable for them because they do not had time to sit down and analyze their own situation,” Mphahlele added
