Judge Motata loses bid to stop drunk driving misconduct inquiry

North Gauteng High Court Judge Nkola Motata has lost a legal bid to stop a misconduct inquiry against him after his conviction of drunken driving.

Motata wanted the court to declare unconstitutional a decision by the Judicial Service Commission that a tribunal be appointed to investigate a hate speech complaint against him.

Motata was convicted of drunk driving in September 2009 after an accident in Hurlingham, Johannesburg.

Civil rights group AfriForum laid a hate speech charge against him following alleged racist remarks he made at the accident scene.
