Khayelitsha residents have given city mayor, Dan Plato, two weeks to replace the toilets he ordered police to remove.
This follows after Plato ordered toilets be removed after ANC Youth League members last week destroyed corrugated iron toilet enclosures, saying they want concrete enclosures.
Plato has been given till the end of business today to iron out the issue with residents or face legal action.
Attorney Thema Langa says the City of Cape Town is guilty of human rights violations and racial discrimination.
However Plato says the toilets will only be replaced once residents build their own enclosures.
Meanwhile eight suspects that were arrested in Makhaza for the public violence are due back in court again today.
Their case was postponed on Tuesday in the Khayelitsha Magistrates Court, while kept in custody.
Twenty six people were arrested in the area follow disruptions over the controversial toilets on Monday.
Eight appeared in court yesterday for Contravening the Gatherings Act during an illegal march in Walter Sisulu Drive in the area.
