The Freedom of Expression Institute believes the Constitutional Court wrongly dismissed Cosatu and transport union Satawu’s appeal.
The appeal was against a judgement holding unions responsible for damage caused during violent strikes.
The Institute says the ruling limits the right to freedom of expression and the right to freedom of assembly provided for in the Constitution.
The FXI says it nevertheless remains committed to the principle that all rights granted by the Constitution should be exercised peacefully.
