Impala Platinum Mines have been charged with homicide.
This follows the death of a worker during a mining accident. Implat failed to make any public disclosures about the incident.
Last month Implat secured an prohibition preventing the release of a documentary of the events that led to the death of Paulus Phethoka in 2007.
The documentary was made by former training manager at the mine Zirk Jansen.
