The hearings
into the so-called spy tapes case will end in the High Court in Pretoria today with
the Democratic Alliance expected to respond to the arguments.
In the
Pretoria High Court on Wednesday, the National Prosecuting Authority argued,
that their independence cannot be trumped for the pursuit of an individual.
The NPA was
defending former head Mokotedi Mpshe's decision to drop corruption charges
against President Jacob Zuma.
NPA Senior counsel Hilton Epstein said their argument was based on the principles of the separation of powers.
"This is
his discretion, the National Director, unless allegations of ulterior motive
didn’t apply his mind, his discretion stands and the court should not impose
its own wisdom, must always be rational, but being unreasonable not
irrational." He concluded.
