The Western Cape High Court
has dismissed an application by the African National Congress, challenging the
City Of Cape Town’s logo.
The party took the
municipality to court because it claims there was no public consultation
process.
In dismissing the application,
High Court Judge Rosheni Allie explained the ANC couldn’t bring the application
on behalf of the public. Lawyers for the city also argued that only the ANC’s
National Executive Committee was able to do that.
An application by ANC
Secretary General Gwede Mantashe, to be allowed to join the court action, was
also turned down. The ANC will now appeal today’s decision.
ANC’s Yonela Diko says “First
of all we note the judgement that has been made by Allie J, the judge. What is
clearly of our significance is that the judged has decided to make a pronouncement
only on the peripheral issues on whether was the ANC Western Cape or the
National Executive Committee of the ANC that got authority to take this matter
to court.”
The actual merits of the case which is lack of
public participation in implementation of changes in this logo, Diko concluded.
